Jake Coleman

Jake regularly advises both claimants and defendants on professional negligence matters involving solicitors, surveyors, financial advisers and estate agents. He has a particular interest in solicitors’ negligence claims relating to property disputes, cyber fraud, personal injury litigation and wills. He is frequently instructed to advise on, and conduct strike out and summary judgment applications.

Jake’s recent cases have involved allegations of:

• A solicitor’s failure to inform his client of rights of way over land, preventing redevelopment;
• Settlement of an employer’s liability claim at an undervalue;
• Failure of a surveyor to spot potential subsidence;
• Failure of an LPA Receiver to pass on proceeds of sale;
• A solicitor’s failure to advise a client regarding costs;
• A barrister’s conduct of a hearing before the Parole Board;
• Failure of a fund manager to divest a client of stock before a crash.

Jake has also been instructed as a junior on several high value claims in which senior members of Chambers have acted.

Jake has a busy clinical negligence practice, advising and appearing on behalf of both claimants and defendants across the spectrum of low-value and high-value cases. He regularly appears in both the High Court and the County Courts in both substantive and interlocutory hearings. Jake also frequently drafts pleadings in complex clinical negligence matters.

Recent cases have involved allegations of:

• Delayed diagnosis of multiple myeloma (a cancer of plasma cells);
• Delayed removal of a kidney;
• Failure to diagnose uterine cancer histologically;
• Failure to diagnose developmental dysplasia of the hip in a baby;
• Failure to obtain informed consent in respect of cosmetic surgery;
• Failure to obtain informed consent in respect of urological surgery;
• Failure of dental implants.

Jake has extensive experience of inquests, including those held under Article 2 (Middleton inquests) and those held with a jury. Jake recently undertook a 6-month secondment with an NHS panel firm where he specialised in coronial proceedings. Jake also regularly represents families at inquests.

Recent cases have included:

• An Article 2, jury inquest, where a man had hanged himself on an acute mental health ward;
• An Article 2, jury inquest, where a young man died when his airway became obstructed by a package of drugs while being restrained by police;
• A jury inquest where the deceased contracted an exceptionally rare lung condition, invasive aspergillosis;
• An inquest where the deceased had suffered an episode of acute behavioural disorder, consequent to cocaine overdose;
• The tragic death of a neonate from a treatable condition, supraventricular tachycardia;
• A death resulting from an incarcerated femoral hernia;
• A death following surgery to remove a gall stone.

Jake has experience of regulatory matters involving doctors, dentists and opticians. He has appeared in fitness to practise proceedings brought by the GMC at the Medical Practitioners Tribunal Service. Jake also frequently assisted with GMC cases and NHS Trust disciplinary proceedings (under the MHPS framework) when he was employed by the Medical Protection Society.

Jake has experience advising on, and representing clients in, commercial law matters including: The Companies Act 2006, contractual disputes and insolvency. Jake has appeared in both the County Court and the Chancery Division of the High Court in such cases.
